These Terms and Conditions ("Terms") govern your access to and use of MenuAI ("Service," "Platform," "we," "us," or "our"), a software-as-a-service platform operated by Podsiekajew.
By creating an account, starting a free trial, or clicking "I agree to the Terms and Conditions," you agree to be bound by these Terms in full. If you do not agree, do not use the Service.

The Service is powered by the Anthropic Claude API and relies on Supabase (database and authentication) and Paddle (payment processing).
You must be at least 18 years old and have legal authority to enter into a binding agreement on behalf of your business. By using the Service, you represent that you meet these requirements.
Restaurant Owners must register with a valid email address, password, restaurant name, and city. You are responsible for the accuracy of this information and for maintaining the confidentiality of your credentials.

Free trials are limited to one per restaurant. Creating multiple accounts to extend trial access is a violation of these Terms.
End Customers (diners) do not create accounts. Chat sessions are anonymous and identified only by a randomly generated session ID. No personally identifiable information is collected from diners.
New Owner accounts receive a 14-day free trial with full access to the Service. No credit card is required to start a trial.
Your trial does not automatically convert to a paid subscription. At the end of the trial period, access will be restricted until an active subscription is established.
MenuAI offers the following subscription tiers:

All prices are in Euros (EUR). Payments are processed by Paddle, which acts as Merchant of Record and handles EU VAT. MenuAI does not store your payment card details.
Subscriptions renew automatically at the end of each billing cycle unless canceled before the renewal date. We will provide at least 30 days' notice before changing subscription pricing.
You may cancel at any time through the billing portal. Cancellation takes effect at the end of the current billing period — you retain full access until then.
We offer a 30-day money-back guarantee on all plans. If you are not satisfied within the first 30 days of your subscription, contact us at mashav2611@gmail.com for a full refund, no questions asked.
After cancellation, your data will be retained for 30 days before permanent deletion. You may request an export during this window.

You retain full ownership of menus, images, logos, and text you upload ("Owner Content"). By uploading, you grant MenuAI a limited, non-exclusive license to process and display that content solely for providing the Service.
MenuAI retains all rights in the platform, technology, and branding. The phrase "Powered by MenuAI" may appear in the customer-facing chat interface and must not be removed or obscured.
From Owners: email, restaurant name and city, menu content, and subscription metadata.
From Customers (diners): no personally identifiable information is collected. Only an anonymous session ID and chat messages are stored.
Your menu content and customer conversations are sent to Anthropic, Inc. via the Claude API to generate AI responses. By using the Service, you consent to this processing.

If you are subject to GDPR or the Israeli Protection of Privacy Law (5741-1981), you have the right to access, correct, delete, or export your data. Contact mashav2611@gmail.com to exercise these rights. We will respond within 30 days.
Important — please read carefully
Dietary flags (vegan, vegetarian, gluten-free, dairy-free, halal, kosher) and allergen information provided by the AI assistant are generated automatically by artificial intelligence based on the menu content uploaded by the restaurant. This information:
MenuAI expressly disclaims all liability for any allergic reactions, dietary compliance failures, or health consequences arising from reliance on AI-generated dietary or allergen information. Restaurant Owners are solely responsible for the accuracy of their menu content.
The AI assistant may occasionally produce inaccurate, incomplete, or inconsistent responses. It is not a licensed nutritionist, chef, or medical professional. Multilingual outputs are AI-generated and may contain translation inaccuracies. MenuAI does not warrant that AI outputs will be error-free or meet your specific requirements.
To the maximum extent permitted by applicable law, MenuAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, lost profits, or business interruption.
MenuAI's total cumulative liability shall not exceed the greater of: (a) the amount you paid MenuAI in the 3 months preceding the claim, or (b) €100.
MenuAI is not liable for service interruptions or failures attributable to Supabase, Paddle, Anthropic, Vercel, or any other third-party provider.
You agree to indemnify and hold harmless MenuAI from any claims, damages, or expenses arising from your use of the Service, your menu content, your violation of these Terms, or any diner claim related to allergen or dietary information you provided.
We may suspend or terminate your account immediately for violation of these Terms, non-payment, fraudulent activity, or legal requirements. You may terminate at any time by canceling your subscription and contacting us.
We will notify you at least 14 days before material changes take effect via email or in-dashboard notice. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the State of Israel. For EU users, applicable EU consumer protection laws apply and are not affected by this choice. Unresolved disputes shall be submitted to the competent courts of Tel Aviv, Israel, unless mandatory local law requires otherwise.
